1. Acceptance of these Terms
This website at verifiedsurgeons.org and its related pages and services (the “Service”) are operated by Verified Surgeons LLC, an Arizona limited liability company (“Verified Surgeons,” “we,” “us”). By accessing, browsing, or submitting any material to the Service, you agree to these Terms of Use and to our Disclaimer, Privacy Policy, and Editorial Policy, which are incorporated by reference. If you do not agree, do not use the Service.
We may update these Terms from time to time. Changes take effect when posted, with a revised effective date. Your continued use after a change means you accept the updated Terms.
2. What the Service is — and is not
Verified Surgeons is an independent informational and accountability platform. We compile, document, and publish source-checked information about surgeons — including identity, credentials, clinic context, and reported conduct — drawn from public records, official registries, and material submitted by users and third parties.
What “verified” means. “Verified” describes a defined factual checking process performed as of a stated date — for example, confirmation of specific public information such as licensure, board certification, and known public sanctions. It is not a recommendation, endorsement, guarantee of competence, or assurance of any treatment outcome, and a verified status can change. The absence of a profile, or any limitation noted on a profile, is not a statement about any surgeon.
Not professional advice. The Service does not provide medical, surgical, legal, or other professional advice, and using it does not create any doctor–patient, attorney–client, or other professional relationship. Choosing a surgeon or a course of treatment is your own decision and responsibility. Always consult a qualified professional.
3. Third-party and user content
A substantial portion of the material on the Service is submitted by users or third parties, or is drawn from public sources. Consistent with Section 230 of the U.S. Communications Decency Act (47 U.S.C. § 230), Verified Surgeons is a provider of an interactive computer service and is not the publisher or speaker of information provided by another information content provider, and is not liable for such third-party content.
Reports, complaints, reviews, and other user-submitted material reflect the accounts, opinions, and evidence of the people who provide them, are presented as such, and do not constitute findings of guilt or the opinion of Verified Surgeons. We may — but are not obligated to — review, screen, edit, label, or remove content at our sole discretion, and doing so does not make us the author of it.
4. Your submissions
When you submit a report, complaint, document, image, review, or other material (“Submission”), you represent and warrant that:
- your Submission is truthful and based on your genuine knowledge, experience, or documentary evidence;
- it is lawful and does not knowingly defame any person or infringe any third party’s rights;
- you have the right to provide it and to grant the license below; and
- you will provide reasonable supporting evidence on request.
You retain ownership of your Submission and grant Verified Surgeons a worldwide, royalty-free, sublicensable, perpetual, and irrevocable license to host, store, reproduce, adapt, publish, display, and archive it in connection with the Service.
Indemnification. You agree to defend, indemnify, and hold harmless Verified Surgeons LLC and its members, officers, agents, and contributors from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your Submission, your breach of these Terms, or your use of the Service.
5. No warranty
The Service and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information is current, complete, or correct. You use the Service at your own risk.
6. Limitation of liability
To the maximum extent permitted by law, Verified Surgeons LLC and its members, officers, agents, and contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, reputation, or goodwill, arising out of or related to your use of (or inability to use) the Service or any content, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) US $100 or (b) the total amount you paid us, if any, in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the smallest amount permitted by law.
7. Corrections, disputes & right of reply
We take accuracy seriously and offer a documented process for anyone who believes information about them is inaccurate or incomplete:
- Submit a correction request or response through our documented process with the specifics and any supporting evidence.
- We evaluate documented requests in good faith and may correct, annotate, publish your reply alongside the entry, or decline with a stated reason, consistent with our Editorial Policy.
- We remove or amend content where required by law or where our review determines it is warranted.
We do not accept payment to add, alter, suppress, or remove any profile, report, or correction. Legal threats, harassment, or attempts at intimidation do not expedite review, are not a substitute for the process above, and may themselves be documented and published.
8. Copyright & DMCA
We respect intellectual-property rights. If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and its location (URL); (4) your contact information; (5) a statement of good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act.
Send notices to our Designated DMCA Agent at dmcaverifiedsurgeons.org. We will respond to valid notices, accept counter-notifications, and terminate repeat infringers in appropriate circumstances. Misrepresentations in a DMCA notice may result in liability under § 512(f).
9. Prohibited conduct
You agree not to use the Service to: submit material you know to be false; harass, threaten, or impersonate anyone; infringe intellectual-property or privacy rights; upload malware; scrape, harvest, or bulk-copy content without permission; or interfere with the operation or security of the Service. We may suspend or terminate access for any violation.
10. Governing law, arbitration & venue
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. Except where prohibited by law, any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered in Arizona under the rules of a recognized arbitration provider, and not in a class, collective, or representative action. You and Verified Surgeons each waive any right to a jury trial and to participate in a class action.
Where arbitration does not apply, the state and federal courts located in Arizona have exclusive jurisdiction and venue, and you consent to personal jurisdiction there. You agree that any claim must be brought within one year after it arises, to the extent permitted by law.
11. International users
The Service is operated from the United States. If you access it from Mexico, South America, or anywhere outside the United States, you do so on your own initiative and are responsible for compliance with your local laws. We process personal data in accordance with our Privacy Policy, which describes how data-subject requests — including access, rectification, and deletion (ARCO) rights — are handled.
12. Changes, severability & contact
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies they incorporate, are the entire agreement between you and Verified Surgeons regarding the Service.
